Welcome to the official website ("the Site") of the USA Weather, Inc. ("USAWX", "we", "our", or "us"). This Privacy Policy explains how information about you is collected, used and disclosed us. This Privacy Policy applies to information we collect when you use our website, mobile application, and other online products and services (collectively, "Services"), or when you otherwise interact with us. The USAWX develops user-friendly backcountry tools for wildfire, avalanche, and weather. By using the Site or by creating an account with us, you consent to the data practices described in this policy.

1. Sharing Information with Third Parties

USAWX does not sell, rent or lease its customer lists to third parties. We may share data with trusted partners to help perform statistical analysis, send you email communications, and/or provide customer support. All such third parties are prohibited from using your personal information except to provide these services to USAWX, and they are required to maintain the confidentiality of your information.

USAWX may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to:

  1. conform to the edicts of the law or comply with legal process served on USAWX or the Site;
  2. protect and defend the rights or property of USAWX; and/or

2. Tracking User Behavoir

USAWX may keep track of different behavior of our uses while on our website, including, but not limited to:

  • Website pages visited, the number of occurences, entrance and exit pages, etc.
  • User click events; tracking when specific links, buttons, or features are clicked, toggled, or changed
  • User location based on your publicly-available internet protocol (IP) address(es)
  • IP addresses that are publicly available

This data may be used to help deliver customized content within USAWX to customers whose behavior indicates that they are interested in a particular content. We use different analytic services to track this type of information. No personal identifying information is ever shared between us and the third-party services. 3. Do Not Track

Do Not Track ("DNT") is a privacy preference that you can set in certain web browsers. We are committed to providing you with meaningful choices about the information collected on our website for third-party purposes, and that is why USAWX provides the variety of opt-out mechanisms listed above in the "User Account Data Collection" section. Information about your computer hardware and software may be automatically collected by USAWX. USAWX secures your non-personal identifiable information from unauthorized access, use, or disclosure. USAWX uses secure-sockets layer (SSL) protocol. When information is transmitted to websites, it is protected through the use of encryption.

We strive to take appropriate security measures to protect against unauthorized access to or alteration of your information. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your information, you acknowledge that:

  2. security, integrity, and privacy of any and all information and data exchanged between your and USAWX, through the the Site, cannot be guaranteed.

8. Right to Deletion

Subject to certain exceptions, on receipt of a verifiable request from you, we will delete your information from our records. Please note that we may not be able to comply with request to delete your information if it is necessary to:

  • Complete the transaction for which the information was collected, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and USAWX.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;

  • Exercise free speech, ensure the right of another users to exercise his or her right of free speech, and or exercise another right provided for by law;
  • Comply with the California Electronic Communications Privacy Act;
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent;

  • Otherwise use your information, internally, in a lawful manner that is compatible with the context in which you provided the information.

9. Children Under Thirteen (13)

USAWX does not knowingly collect personally identifiable information from children under the age of thirteen (13). If you are under the age of thirteen, you must ask your parent or guardian for permission to use the Site.

10. Email Communications

From time to time, USAWX may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. In order to improve our Services, we may receive a notification when you open an email from USAWX or click on a link therein. USAWX uses a third-party for us to administer and manage our mailing lists. This does not mean we sell your information, but rather use a service for our management of mailing lists and email content. You can subscribe to our mailing list via our website or our mailing list provider. If you subscribe to our mailing list from our website, your email address will be sent to our mailing list provider. This information is sent securely through encrypted channels.

If you would like to stop receiving marketing or promotional communications via email from USAWX, you may opt-out of such communications by clicking the "unsubscribe" button or link at the bottom of the email that was sent to you. If you have a USAWX account, you can also opt-out of receiving USAWX's marketing emails by logging into your account, navigating to "notifications," and unsubscribing there.

Notwithstanding, USAWX maintains the right to send you electronic communications at any time if it pertains to your account on the USAWX website. Unsubscribing from USAWX emails only pertains to marketing and announcement emails..

11. Changes to this Policy

We reserve the right to change the Privacy Policy periodically or when necessary. We will notify you about significant changes by sending a notice to the primary email address specified in your account, by placing a prominent notice on our website, and/or by updating any privacy information on this page. Your continued use of the Site and/or Services available through this Site after such modifications will constitute your acknowledgment of, and agreement to abide by, the modified Terms of Service, bound by the Terms of Service.
